Other related technology products and solutions

The availability of specific products or services may vary from time to time and may be subject to separate agreements, quotations, service orders, or subscription plans.

We reserve the right to modify, suspend, discontinue, or replace any product, service, feature, or functionality at our sole discretion without prior notice where permitted by law.

3. Eligibility and Account Information

By using our services, you represent and warrant that:

You have the legal capacity and authority to enter into a binding agreement.

6. Subscription Services

By subscribing to a recurring service, you authorize Gest Technology Sdn Bhd and its payment processing partners to automatically charge your selected payment method according to the applicable billing cycle.

Subscription fees are payable in advance unless otherwise stated.

The Company reserves the right to revise subscription pricing, features, or service offerings. Any material pricing changes will take effect upon the next renewal cycle unless otherwise required by law.

7. Automatic Renewal

To ensure uninterrupted service, subscriptions automatically renew at the end of each billing cycle unless cancelled before the applicable renewal date.

By enrolling in a subscription plan, you acknowledge and agree that:

Your subscription will continue until cancelled.
Renewal charges may be processed automatically using your designated payment method.
Renewal billing attempts may occur between fourteen (14) and thirty-one (31) days prior to the service expiry date for administrative and processing purposes.
Renewal charges may vary if pricing changes have been communicated in advance.

Customers are responsible for monitoring subscription renewal dates and maintaining valid payment information.

8. Failed Recurring Payments

Customers are solely responsible for ensuring that valid and sufficient payment methods remain available for recurring billing.

If a recurring payment cannot be successfully processed for any reason, including insufficient funds, expired cards, payment restrictions, or banking issues:

Service renewal may fail.
Customer access to software platforms, dashboards, portals, and management systems may be suspended.
Connected devices requiring active subscriptions may cease functioning.
Technical support services may be restricted.
Services may be terminated until all outstanding amounts are paid in full.

The Company may attempt additional payment collections where permitted by applicable laws and payment network rules.

Gest Technology Sdn Bhd shall not be responsible for any losses, damages, business interruptions, missed transactions, loss of revenue, or operational disruptions resulting from unsuccessful payment collection or service suspension due to non-payment.

9. Customer Responsibilities

Customers agree to:

Provide accurate and complete information.
Maintain valid payment methods and billing details.
Comply with all applicable laws, regulations, and industry requirements.
Use products and services only for lawful and authorized purposes.
Protect account credentials and access information.
Promptly report unauthorized access or security incidents.
Follow all operational instructions, guidelines, and technical requirements provided by the Company.

Customers shall not:

Attempt unauthorized access to systems or networks.
Interfere with the operation or security of our services.
Reverse engineer, modify, copy, or exploit software without authorization.
Use our services for fraudulent, illegal, or harmful activities.
Introduce malicious software, viruses, or harmful code into our systems.

10. Hardware, Software, and Third-Party Services

Certain products and services may rely on third-party providers, including payment gateways, telecommunications providers, cloud infrastructure providers, financial institutions, and software vendors.

While we strive to maintain reliable services, we do not guarantee uninterrupted availability of third-party systems beyond our control.

Service interruptions, delays, outages, or failures caused by third-party providers shall not constitute a breach of these Terms by the Company.

Customers acknowledge that compatibility, connectivity, and performance may depend on external systems and infrastructure.

11. Intellectual Property Rights

All intellectual property rights relating to our products, software, websites, content, trademarks, logos, branding, graphics, documentation, designs, source code, databases, and related materials remain the exclusive property of Gest Technology Sdn Bhd or its licensors unless otherwise stated.

Nothing in these Terms grants customers ownership of any intellectual property rights.

Customers may not:

Copy or reproduce proprietary materials.
Modify or create derivative works.
Distribute or resell protected content without authorization.
Remove copyright, trademark, or proprietary notices.

Unauthorized use of intellectual property may result in legal action.

12. Warranties and Disclaimers

To the fullest extent permitted by law, our products and services are provided on an "as is" and "as available" basis.

While we strive to provide accurate information and reliable services, we do not guarantee that:

Services will be uninterrupted or error-free.
Software will be free from defects or vulnerabilities.
All issues can be resolved immediately.
Products will meet every customer's specific requirements.

Except where required by applicable law, all express or implied warranties are excluded to the maximum extent permitted.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Gest Technology Sdn Bhd, its directors, officers, employees, affiliates, agents, and partners shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to:

Failed payment processing
Loss of business opportunities
Loss of profits or revenue

Unauthorized access to customer accounts

Where liability cannot be excluded by law, our total aggregate liability shall be limited to the amount paid by the customer for the affected product or service during the twelve (12) months preceding the event giving rise to the claim.

Customers agree to indemnify, defend, and hold harmless Gest Technology Sdn Bhd and its affiliates, directors, officers, employees, and representatives from and against any claims, liabilities, damages, losses, costs, or expenses arising from:

Violation of these Terms
Misuse of products or services
Breach of applicable laws or regulations
Infringement of third-party rights
Unauthorized activities conducted through customer accounts

15. Suspension and Termination

We reserve the right to suspend, restrict, or terminate access to any product, service, account, or subscription at our discretion where:

Payment obligations are not fulfilled.
Fraudulent or suspicious activity is detected.
Customers violate these Terms.
Continued service provision would expose the Company to legal, regulatory, or security risks.

Termination of services shall not relieve customers of outstanding payment obligations accrued prior to termination.

16. Changes to Terms

We may update, revise, or modify these Terms from time to time to reflect changes in our business operations, legal requirements, technologies, or services.

Updated Terms will be published on our website together with the revised effective date.

Continued use of our website, products, or services after such updates constitutes acceptance of the revised Terms.
